The Italian National Institute of Social Security (INPS) has issued new administrative instructions regarding access to unemployment benefits for those in the emergency quota (INPS Circular, March 25, 2025, n. 69). The regulations apply to those confirmed as honorary magistrates in the emergency role after the evaluative processes of 2023. Following the enactment of article 15-bis, paragraph 2, of the D.L. n. 75/2023 as well as the interpretation from article 2, D.L. n. 131/2024, the NASpI contribution payment is due for these individuals, thus extending their insurance coverage.
The contribution obligation is guaranteed by applying rates set for the majority of employees registered with the FPLD. The INPS instructions focus on access to NASpI unemployment benefits for confirmed honorary magistrates part of the emergency quota mentioned in article 29, D.Lgs. n. 116/2017. These individuals have opted for the exclusive honours functions regime and are registered with the mandatory general insurance of the Institute.
INPS also specifies that only for job terminations occurring between the date of the onset of the NASpI contributions and March 25, 2025, the term of 68 days to apply for NASpI runs from the latter date. In this case, the benefit starts from the day following the application, subject to standard delays in compensation if applicable, as outlined by the INPS Circular n. 94/2015, paragraph 2.7.
For voluntary terminations occurring after the publication of the circular, the 68-day term applies according to standard rules (as outlined by the INPS Circular n. 94/2015 paragraph 2.6), with the benefit effective according to the general rules (paragraph 2.7 of the same circular n. 94/2015).
INPS advises potential applicants to apply exclusively online, using their digital identity SPID of at least level 2, CIE, or CNS on the dedicated service on the institution’s website. Alternatively, applications can be made through counseling organizations, or via the multi-channel Contact Centre service. The circular also summarizes the requirements for accessing the benefit, its measure, and duration.
