Guidelines for the concession of gradualism have been established where the application of the economic content of the contract becomes complex. This is set out, as of the 7th of April, in the application note related to the article 77 of Social Cooperative CCNL, in relation to gradualism. The application note was signed by organizations Agci-Imprese sociali, Confcooperative-Federsolidarietà, Legacoopsociali, Fp-Cgil, Cisl-Fp, Fisascat-Cisl, Uil-Fpl, and Uiltucs.
The document, disseminated to the competent territorial offices, declares the correct and integral application of the contract, until the date of presentation. It discusses the failure to recognize contractual adjustments in a contract or accreditation regime, demonstrating the economic and temporal dimensions of the contracts affected. Moreover, the document outlines the critical aspects of the company’s financial conditions, documenting the potential use of social cushions, highlighting existing states of crisis, and reporting other requests for gradualism in other areas or regions.
The note emphasizes that applications for gradualism should reach the regional/provincial commission, territorially competent, at least 60 days before the start of the wage increases. The workers involved in the possible gradualism path are those involved in the management of services within the region and/or territory where the supervening difficulty makes the application of the economic content of the contract complex.
The possible concession of gradualism must be envisaged for a limited duration. This is a tool to help companies in difficulty to apply the content of the contract, especially in an environment where there may be complex, economic challenges.
