The Italian National Insurance for Occupational Diseases and Injuries (INAIL) has issued instructions regarding updates to the age limits for the disbursement of the unemployability allowance, as established in Article 9, paragraph 1 of Legislative Decree no. 159/2025. These updates increase the maximum age limit for receiving the allowance, introducing a criterion for periodic adjustment to the retirement age.
Under these new provisions effective from January 1, 2026, the unemployability allowance is extended to insured individuals who meet certain conditions until they reach the age of 67. According to the new formulation, any increase in the retirement age will automatically adjust the age limit for receiving the economic benefit as well.
The extension applies to the following categories of insured individuals:
– Recipients of a direct pension with a currently disbursed allowance, who will turn 65 years old from January 1, 2026
– Recipients of a direct pension who, while meeting the requirements, turned 65 before January 1, 2026, and are therefore no longer receiving the allowance
– Recipients of a direct pension who, despite meeting the requirements, have never applied and have consequently never received the allowance.
