The article provides information about the effects of the regulation referred to in paragraph 2 of article 10-bis of Decree Law n.92/2025, as illustrated by the National Institute of Social Security (INPS) in its circular of December 3, 2025, n. 149.
According to Article 10-bis, subparagraph 2 of DL n.92/2025, periods of special cash assistance for agricultural workers (CISOA) enjoyed by both permanent and temporary agricultural laborers due to climate emergencies from July 1 to December 31, 2025, have been equated to employment for the calculation of agricultural unemployment benefits. This is done under the conversion, with changes, of Law no. 113/2025.
The INPS circular explains the impact of the new regulation on the calculation of the agricultural unemployment benefits for the year 2025. It pays special attention to the group of beneficiaries, the extent of the measure that equates periods of CISOA to employment, and the impacts of the standard on the completion of the contributory requirement needed for access to the benefits. It also discusses the calculation of the said benefits and the reference wage to be used to identify the amount to be dispensed in relation to periods of CISOA equated to employment.
However, agricultural workers employed by cooperatives and their consortia, who have been accessing NASpI since January 2022, are excluded from CISOA for weather conditions (Law n.240/1984).
The access requirements to the agricultural unemployment benefit for seasonal inclement weather are as follows:
– Permanent agricultural workers must have worked at least one day effectively in 2025.
– Temporary agricultural workers must be enrolled in the annual lists for at least one day of effective work in 2025.
Finally, INPS has outlined the contribution requirements to access the agricultural unemployment benefits, and the methods of calculating these benefits and the reference wage.
