Accordo tra INAIL e INPS per la gestione degli infortuni dei giornalisti

The document discusses employees with a dependency relationship in relation to events that occurred on June 30, 2022, as outlined in the INAIL circular dated July 5, 2024, no. 19. Following the transfer of the pension function from INPGI to INPS on July 1, 2022, in place of corresponding mandatory pension schemes for professional journalists, publicists, and interns with a journalistic employment relationship, the transfer also included ownership of active and passive relationships, including those related to the “Accident Insurance Fund” and the management of accidents occurring until June 30, 2022.

For accidents occurring after June 30, 2022, and until December 31, 2023, management of insurance was assigned to INAIL, with regulations from INPGI in force as of June 30, 2022, to be applied. Given INAIL’s expertise in accident matters, INPS requested to enter into an agreement under Article 15, paragraph 1, of Law No. 241/1990, to handle accident cases occurring before June 30, 2022, which were not yet resolved by INPGI at the time of the transfer.

The agreement between INPS and INAIL established that INPS retains ownership of active and passive relationships related to accidents until June 30, 2022, while INAIL handles administrative activities for accident reports, medical evaluations to determine disability or death, and quantifying benefits for injured journalists, charged to the Accident Insurance Fund. Regulations active on June 30, 2022, are applied for these accident cases.

The continuing management of accidents until June 30, 2022, follows regulations in force as of that date, specifically the INPGI Regulation of June 24, 1980, and the attached disability table, as well as articles 38 and 41 of the national journalist labor contract signed on June 24, 2014. The Regulation provides for compensation in case of accidents resulting in death or permanent disability, based on specified rules and the attached table. Heart attacks and strokes are also covered by the insurance.

For permanent disability compensation, the journalist must provide a medical certificate post-recovery, estimating the residual degree of permanent disability based on the table attached to the INPGI Regulation. When the degree of disability exceeds 5%, or in cases of death due to the accident, the central insurance relations department calculates the compensation and travel expenses to be reimbursed to the journalist.

The results of the investigation are communicated by the central INAIL office to the Rome Flaminio branch of INPS. A list of cases, payment amounts, administrative documentation for benefit payments, and medical records supporting claims are sent monthly. Within 30 days of receiving this information, the INPS branch finalizes the cases and issues payments to beneficiaries as per the Agreement.

The central insurance relations department reports cases where legal action may be necessary based on collected documentation and handles revision requests for recognized disability degrees. INAIL manages any appeals against partial approval or rejection decisions and participates in medical boards for appeals as outlined in the INPGI Regulation.
