CIPL Terziario Rimini: Agreement signed for seasonal fixed-term employment contracts

On 13 March 2025, Confcommercio Imprese per l’ltalia from the province of Rimini, Filcams-Cgil Rimini, Fisascat-Cisl Romagna, and Uiltucs-Uil Emilia Romagna met to discuss contracts for fixed-term work carried out by companies applying the current National Collective Labour Agreement for Tertiary, Distribution, and Service sectors. These companies do not operate on a seasonal basis as outlined in the attached list of the Presidential Decree October 7, 1963, no. 1525, but they need to manage work peaks associated with seasonal changes.

As per article 75 of the National Collective Labour Agreement for Tertiary, Distribution, and Services (CCNL TDS), the actual periods of seasonality have been identified. These periods will start from 15 March until 31 October 2025. The duration of this period is considered to be experimental for the 2025 season.

After an initial phase of monitoring the use of these contracts and further specific requirements of flexibility in the use of labor resources in different areas of the provincial territory, the parties may identify additional periods and/or municipal territories or portions of territories through a separate and additional agreement.

The Social Parties also specified that fixed-term employment contracts made due to seasonality, under the provisions of the article 75 of the CCNL TDS in force, are excluded from quantitative limitations in accordance with article 23, paragraph 2, letter c), of the Legislative Decree n. 81/2025. They are also excused from duration limitations of the relationship, from limitations on the time intervals predicted, and from the necessity to have to justify the reasons for extensions and renewals.

This means companies can manage their workforce and resources more flexibly during peak periods of activity without the legal restrictions usually applied to fixed-term contracts. The adaptability to the business’s needs and the permission to engage additional workforce during peak times signify significant changes in the labor market regulation for Tertiary, Distribution, and Service sectors.

In the future, this agreement and the designated period of seasonality could be revised and adjusted based on the observed trends and feedback from the participating parties. This stipulation provides an opportunity for ongoing assessment and modification of labor contract terms. These legislative changes aim to effectively manage high workloads during seasonal peaks and cater to the specific workforce needs of different territories.
