The Council of Ministers has definitively approved a legislative decree, implementing article 3, paragraphs 1 and 2, letter b), of Law no. 160/2023 (Ministry of Labour and Social Policies, press release 21 November 2025). In the session of 20 November, the Council of Ministers gave the final green light to a legislative decree named “Code of Incentives”, in implementation of article 3, paragraphs 1 and 2, letter b), of Law no. 160/2023.
The measure harmonises the general regulations regarding incentives for companies, defines the general principles that regulate administrative procedures that companies must follow to access benefits, and provides the relevant provisions for the use of functional technical equipment. This is a decree that aims to simplify procedures, provide legal certainty, and facilitate the participation of all productive categories. It introduces, at article 10, the principle of parity between self-employed workers and companies in requests for incentives. In compatible public tenders, self-employed workers will be able to participate under the same conditions provided for small and medium-sized enterprises, excluding non-pertinent requirements in their activity. The tenders will define specific provisions to guarantee effective and non-discriminatory access.
This concludes a process initiated with Law no. 81/2017 and frequently referenced in conversations with professional categories at the Ministry of Labour and Social Policies.
