The Milleproroghe Published in the Official Gazette: The Updates

The Decree-Law no. 2024/2024, officially known as the Milleproroghe Decree 2024, has extended the possibility of using fixed-term labor contracts based on technical, organizational, or productive requirements in the private sector until the end of 2025. This extension applies only when there are no contract terms listed in collective bargaining agreements. The provision is governed by article 19, paragraph 1, subsection b) of the Legislative Decree no. 81/2015.

The decree, which was officially published on December 27th, brings a few changes regarding labor laws. Additionally, it limits recruitment in public administration to a 3 year term starting from 2025. It further extends the privilege for Non-Profit Organizations (ONLUS) to gain accreditation to access five-per-thousand allocation even if not registered with RUNTS until December 31, 2025.

Finally, the decree reassigns the responsibility of carrying out investigative activity for the determination of the essential performance levels (LEP) and their costs and standard needs to the Department for Regional Affairs of the Prime Minister’s Office. This is valid until December 31, 2025, starting from December 5, 2024.

These policies and alterations, introduced by the Ministry of Labor and Social Policy, bring significant changes to labor laws and produce a shift in the dynamics of contract-based employment. The private sector can now adapt to various technical, organizational, or production requirements and alter labor contracts based on the needs of the parties until the end of 2025. The sculpting of these rules in the public sector is expected to create a more structured atmosphere for roles in public administration by limiting their tenure to three years.

The decree also provides an extended possibility for Non-Profit Organizations to gain access to the five-per-thousand allocation, thus facilitating access to funding for these organizations and encouraging their contributions to society.

Moreover, it places the investigative role for determining the essential performance levels and the associated costs onto the Department for Regional Affairs of the Prime Minister’s office. This reassignment is expected to bring about a uniform structure and a better approach to determining the performance-level requirements in different regions.

This is noteworthy as it represents clear-cut measures and amendments the government is willing to take to ensure efficient workforce management and funding allocation to foster enhanced productivity and growth in both the private and public sectors.
